1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Buildenfra platform, websites, and related services (the "Service"), operated by Buildenfra ("Company", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

• Service: The Buildenfra ERP platform, mobile applications, and websites.
• Account: A unique account created for you or your organization to access the Service.
• Customer: The organization that subscribes to the Service.
• User: An individual authorized by the Customer to use the Service.
• Content: Any data, files, or information submitted to the Service by Users.

3. Accounts & Eligibility

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. You must notify us promptly of any unauthorized use.

4. Subscriptions & Payment

Access to the Service is provided on a subscription basis, priced by active projects and users as agreed in your order or quote. Fees are payable per the agreed billing cycle. Unless stated otherwise, fees are exclusive of applicable taxes, which you are responsible for.

5. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Service or its systems.
• Reverse engineer, copy, or resell the Service except as permitted.
• Upload malicious code or interfere with the integrity of the Service.

6. Customer Content & Data

You retain all rights to your Content. You grant us a limited license to host and process your Content solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy.

7. Third-Party Services & Integrations

The Service may integrate with third-party tools (such as Primavera, accounting, or ERP systems). We are not responsible for third-party services, and your use of them is governed by their respective terms.

8. Intellectual Property

The Service, including its software, design, and content (excluding Customer Content), is owned by the Company and protected by applicable intellectual property laws. These Terms do not grant you any right to our trademarks or branding.

9. Service Availability

We aim to provide a reliable Service with high availability and regular backups. The Service is provided on an "as is" and "as available" basis, and we do not warrant that it will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages, or for any loss of profits or data, arising from your use of the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. On termination, your right to use the Service ceases; we will make your Content available for export for a reasonable period as agreed.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Ranchi, Jharkhand.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
